Update Your Privacy Policy to Comply With New Zealand’s Privacy Act 2020

In this support article, we’ll show you how to update your Termly privacy policy to comply with the data privacy laws in New Zealand, specifically New Zealand’s Privacy Act 2020.

Termly updates the policy generators to reflect changes in data privacy laws that may impact our users. When an update occurs, we send an email to Termly users with information about the changes. It is your responsibility to implement the appropriate updates as needed in your Termly Dashboard.


1.1 Who must comply?

New Zealand’s Privacy Act 2020 requirements are applicable to any of the following “agencies” that collect, use, share, or store personal information from individuals inside New Zealand:

  • New Zealand agencies (whether or not present in New Zealand)

  • Overseas agencies that carry out business in New Zealand

  • Individuals who are not ordinarily residents in New Zealand, regardless of where the personal information is subsequently held or where the individual to whom the information relates is located

“Agency” is the term used by the law itself but can refer to a person, business, or organization.

1.2 Updating your policy to comply with New Zealand’s Privacy Act 2020

If you want your policy to be compliant with the Privacy Act 1988, Privacy Act 2020, or POPIA, log into your Termly Dashboard and follow these steps in the generator.

Note: These are similar steps you take to comply with Australia’s Privacy Act 1988 or South Africa’s POPIA.

Step 1

To start, simply select which privacy law you want your policy to cover, in this case, New Zealand’s Privacy Act 2020.

Step 2

Now click PUBLISH to update your policy, and you are finished.
